HENRY HAYS

BAR

     Henry Hays, born September 30, 1849, enlisted in Company "D" of the 1st W. Va. Infantry in April 1864. Later that year, the unit became the 2nd W.Va. Veteran Infantry.

     Henry was the son of Abraham Hays (s/o Isaac), born abt. 1794, and Lydia Goodnight, born about 1795, both in Marion County, W.Va.

     On September 16, 1869, Henry married Margaret McKinney, born May 26, 1849. Their children were:

     Henry Hays died July 9, 1896. He is buried at Cedar Grove Cemetery, Tyler Co., W.Va.

     The West Virginia Civil War medal of Henry Hays is in the possession of his great-grandson, William Hayes.

Declaration for Original Invalid Pension

State of West Virginia
Doddridge County

     On this 12" day of April, A.D. one thousand eight hundred and 90 personally appeared before me, Clerk of the Circuit Court, a court of record within and for the County and State aforesaid, HENRY HAYS aged 40 years, a resident of the Dist of Grant, County Doddridge, State of W.Va., who, being duly sworn according to law, declares that he is the identical Henry Hays who was enrolled on the 13th day of April, 1864, in Company D of the 2" Regiment of W.Va. Inft. commanded by Capt. John W. Plattenburg and was honorably discharged at Wheeling, W.Va. on the 16th day of July, 1865; that his personal description is as follows: Age, 18 years; height, 5 feet One inches; complexion, fair; hair, Brown; eyes, grey.

That while a member of the organization aforesaid, in the service and in the line of his duty at Port Republic, in the State of Va. on or about the last of May or first of June, 1864, he contracted Rheumatism and Heart disease on the march from Woodstock to Port Republic, also at Martinsburg, W.Va. while in Hospital he took Diarrhea, Resulting in Piles.

That he was treated in hospitals as follows: At Martinsburg W.Va. in about June 1864.

That he has not been employed in the military or naval service otherwise than as stated above.

That since leaving the service this applicant has resided in the counties of TYLER & DODDRIDGE in the State of W.Va., and his occupation has been that of a FARMER.

That prior to his entry into the service above named he was a man of good, sound physical health, being when enrolled a FARMER. That he is now 3/4 disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the service of the United States; and he therefore maked this declaration for the purpose of being placed on the invalid pension roll of the United States.

     He hereby appoints, with full power of substitution and revocation, F. M. NOBLE of WEST UNION, W.Va. his true and lawful attorney to prosecute his claim. That he has not received nor applied for a Pension. That his Post-Office Address is KENTON county of DODDRIDGE State of W.Va.

Statement of Henry Hays

West Union, W.Va. January 9" 1891
Com'r of Pensions

     In reply to call no 18, I would say, on my return home from U.S. Service I located at Shirley, in the County of Tyler, State of W.Va., where I remained until about 1869, then I moved near West Union in Doddridge County W.Va. where he lived until about 1872, then I moved to Knights P.O. in Doddridge County, where he resided until the present but his P.O. now is Kenton a (new office). That while at Port Republic Va about the last of May or first of June 1864 I contracted Rheumatism and disease of heart, brought on by over exertion while on a forced march from Woodstock to Port Republic and exposure while on march, in May or first of June 1864, as aforesaid, and while in Hospital at Martinsburg W.Va. I took Diarrhoea which caused Piles. I was first treated by the Regimental Surgeon then was sent to Hospital at Martinsburg W.Va., about June 1864. And after discharge in a month or two I was treated by Dr. Amaziah Ashburn of West Union, W.Va. and then about 1884 Dr. Silas Cavalier now of Sardis, W.Va. I was also treated by Dr. S (or L) R. Charter of West Union W.Va. Cannot give the date, and then at different times by Dr. A. Ashburn of West Union W.Va. who has been my Family Physician. That when Dr. Charter treated me, I believe about 1873, I was totally unable to do any labor for about eight weeks. Then about 1883 for about 3 months and then during the winter of 1888 & 1889, was unable to do any labor, and at various times for two or three days at a time, and in fact, I am more or less disabled all the time and have been since the origin of said disabilitites.

Marriage Record

State of West Virginia, Doddridge County, To-wit:
     I, Luther E. Kile, Clerk of the County Court of said county, and as such Clerk having the care and custody of the records of Marriages of said county, do certify that the records show that HENRY HAYS and MARGARET S. (or L.) KINNEY were married by Wm. Strickling on the 16 day of September 1869.

From Enrmt to M/O, he held the rank of Pvt. and during that period the rolls show him present except as follows June 30/64 In Hospl at Martinsburg, Va. Aug 31/64 same. Oct 31/64 Sick in Hospl in Annapolis Md.

Records show him returned from Hospl July 11/64.

The medical records show him treated as follows:

Declaration for Widow's Pension

     On this 23 day of July, A.D. one thousand eight hundred and ninety six, personally appeared before me, Curtis L. Lyon Deputy Clerk of the County court, the same being a Court of record within and for the county and State aforesaid MARGARET HAYS, aged 47 years, a resident of the P.O. of Kenton, county of Doddridge, State of West Virginia, who, being duly sworn according to law, declares that she is the widow of HENRY HAYS, who enlisted under the name of HENRY HAYS on the 13" day of April A.D. 1864, in Co "D" 2nd Regt. W.Va. Inft. Vols Veterans and served at least ninety days in the late War of the Rebellion, who was Honorably Discharged July 16" 1865 and died July 9" 1896.

That she was married under the name of MARGARET KINNEY, to said HENRY HAYS, on the 16 day of September 1869 by Rev Wm Strickling in Doddridge Co., W.Va. there being no legal barrier to said marriage neither she nor her husband had been previously married.

That she has not remarried since the death of the said Henry Hays.

That she is without other means of support than her daily labor. That names and dates of birth of all the children now living under sixteen years of age of the soldier are as follows:

     In the matter of the application for pension of MARGARET HAYS widow of HENRY HAYS, Co "D" 2" Regt. W.Va. Inft. Vols.

     On this 29 day of December A.D. 1896, personally appeared before me a Clerk of the County Court in and for the aforesaid County, duly authorized to administer oaths, MARGARET HAYS aged 47 years, a resident of KENTON in the County of DODDRIDGE and State of W.Va. whose Post-Office address is Kenton, Doddridge Co W.Va. .... well known to me to be respectable and entitled to credit, and who, being duly sworn, declare in relation to the aforesaid case as follows:

That she is the above named claimant, and makes the following statement in order to make corrections in regard to names of children claimed for which are as follows:

instead of Willie born Dec 26" 1890. That Mr. Reed who wrote the name and date in the family record wrote in Dec and made the mistake by writing Dec instead of Nov and then it was changed as appears on the record.

That she herewith presents the original family record which she declares to be the True and Original family record as kept by them, which she offers in evidence as to names, dates of Birth of the children and date of death of Henry Hays her late husband.

Kile Clerk of the County Court of said County and as such Clerk having the care and custody of the records of the Real and Personal estate of said County do certify that the records show that for the year 1895 Henry Hays is charged with Personal Property valued at $160 and for the year 1896 Personal estate valued at $175 and that said years of 1895 and 1896 he is not charged with real estate in said county of Doddridge.
