Declaration of Original Pension of a Widow -- Child or Children under Sixteen Years of Age Surviving

On this 12th day of May , A.D. one thousand eight hundred and ninety personally appeared before me, Clerk of District Court , the same being a court of record within and for the county and State aforesaid, Nancy J. Haymond aged 44 years who, being duly sworn according to law, makes the following declaration in order to obtain the pension provided by Acts of Congress granting pensions to widows; That she is the widow of Thomas H. Haymond at Fairmont, VA in Co. F 12th Regt. Va. Vols. 1861-5, who was discharged from said service, February 7th 1863, having contracted disease of throat & bronchitis while in line of duty from exposure on a march near Beverly Va., about November 1862 and who died from disease of lungs at Palatine W.Va. on the 19th day of June, A.D. 1876 who bore at the time of his discharge the rank of 2nd Lieut. in said Co. F 12th Va. V., that she was married under the name Nancy J. Sterling to said Thomas H. Haymond on the 5th day of February, A.D. 1867 , by Rev. C. Conner at Palatine W. Va., there being no legal barrier to such marriage; that neither she nor her husband had been previously married, that she has to the present date remained his widow; that the following are the names and dates of birth of all his legitimate children yet surviving who were under sixteen years of age at the father’s death, to wit:

That she has not abandoned the support of any one of his children, but that they are still under her care or maintenance said Rev. C. Conner is deceased & she cannot get his testimony that she has not in any manner been engaged in, or aided or abetted, the rebellion in the United States; that no prior application has been filed, that she hereby appoints E. North of Clay Center Kans. her attorney to prosecute her claim; that her residence is Clay Center Ks and that her post-office address is Clay Center Kans.

Also personally appeared Robert D. McCord residing in Clay Center K. and Ernest D. Bowers in Clay Center Ks, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, day that they were present and saw Nancy J. Haymond the claimant, sign her name to the foregoing declaration; that they have every reason to believe, from the appearance of said claimant and their acquaintance with her, that she is the identical person she represents herself to be; and that they have no interest in the prosecution of this claim. I A. N. Prichard , being duly sworn depose and say That I was formerly a Captain in Co. F. of the 12th Regiment of Virginia Vols., the Thomas H. Haymond, a 2nd Lieutenant in Co. F. of said Regiment, while strictly in line of duty, in said service, contracted and received the following Disease under the following circumstances, Our command started from Beverly Virginia on the 5th of November 1862 in the Monteroy raid or scout by way of Mingo Flats, Huntersville, Monteroy, & Beverly to New Creek Virginia and there joined the command on the way to the Valley of Virginia, said Thomas H. Haymond was sent to the Hospital from New Creek to Cumberland Maryland and returned to the company at Winchester, Virginia that he remembers that when said Haymond returned to the command, he was complaining and suffering with his throat, breast and lungs and was very hoarse and coughing considerably & that he was discharged from the service in the early months of 1863 while yet at Winchester. To all appearances the said Haymond was a stout able bodied man when he entered the said service and remained so up to the time of said raid or scout and was always willing and ready for duty.
That he remembers that shortly before his discharge the said Haymond talked to him about his condition and said that the surgeon had advised him that he had better resign the service on account of his declining health and that he from what he knew of his condition sanctioned and encouraged that course.

I Thomas A. Fleming , being duly sworn depose and say That I was formerly a 1st Lieut. in Co. F. of the 12th Regiment of Virginia Volunteers., the Thomas H. Haymond, a 2nd Lieutenant in Co. F. of said Regiment, while strictly in line of duty, in said service, contracted and received the following An affection of the throat and lungs. under the following circumstances, Our Company and Regiment was required to do some very hard marching and other duty during the autumn of 1862, and the first part of the following winter, and the weather being wet and at times very cold there was much suffering in the command. Prior and up to about the 1st of November 1862 said Lieut. Thos. H. Haymond appeared to be stout and seemed to be in the enjoyment of good health. During the months of November or December 1862, which in line of duty, said Thomas H. Haymond contracted said affection of throat & lungs which rendered him incapable of performing his duties as an officer in said company, which he had willingly done before. I remember distinctly while at Winchester Va. in the month of January, or early part of February 1863, that he coughed almost constantly, complained of his throat & breast, and kept his throat wrapped with a large comforter and when he talked, did not speak above a whisper and that he soon thereafter resigned which I believe he did on account of said affection of throat and lungs, as he told me the Surgeon had advised him to do. After the close of the war and I had come home I occasionally met him and he was still suffering from the dame affection.

In the matter of the widow’s original pension claim of Nancy J. Haymond widow of Thomas H. Haymond, of late a 2nd Lieut in Co. F of the 12th Regt. of Va. Vols.
Personally came before me a Clerk Circuit Court in and for said County and State J. H. Brownfield whose residence and Post Office address is Fairmont County Marion, State of West Virginia who being sworn declares in relation to aforesaid case, as follows:
I have been a practicing physician and surgeon for 30 years last past. I have an acquaintance with said soldier, and had knowledge of his physical condition for the year 1862 till the year 1876 inclusive.
That I was acquainted with said soldier prior to his enlistment but had no knowledge of his physical condition that in December 1862 while he was at home on furlough I prescribed for him for disease of the throat, they nature of which I can not now remember, but think it was bronchitis with laryngitis. My book shows that I prescribed for him December 26 1862, Jany 1st 4th, April 4, May 6 & 15 1863, which was for the said disease of throat. That I prescribed for him frequently & at different times for the disease of his throat form 1863 to 1875 inclusive, but having no record or change of treatment I can not give dates of prescriptions, he paying for the prescriptions at the time they were given. That Phthisic pulmonitis developed as sequela of the throat affection in the fall of 1875. That I prescribed for him on Oct 9, 1875 and visited him at his home & treated him on Dec 18 1875 and visited him daily from this date until the time of his death June 19 1876. My books show a continuous treatment from October 9, 1875 until June 19, 1876. That the immediate cause of death was Phthisic pulmonitis resulting in my opinion from the said throat affection from which he suffered & was treated by me from December 1862 until the time of his death June 19, 1876.
I further declare that I have no interest in said case and am not concerned in its prosecution, and am not related to said applicant.
